Terms and Conditions of Online Sale to Individual Consumers

Article 1 – Scope and Purpose

These Terms and Conditions of Sale (hereinafter “T&CS”) apply, without restriction or reservation, to all sales concluded by Lina Pasteur (Lina MA, sole proprietorship, SIRET: 953 592 409 00023, email: lina.pasteur.rosa@gmail.com) via its website linapasteur.fr, with non-professional individual consumers (hereinafter “the Customer”).

These T&CS govern the online purchase of specialized pet care textiles, specifically the Bunrito® restraining wraps, as well as any related pet accessories offered on the website.

Placing an order on the website implies full and unreserved acceptance of these T&CS, which prevail over any other document.

Article 2 – Products and Availability

The products offered for sale are those presented on the website linapasteur.fr on the day the Customer consults it. Each product is accompanied by a detailed description specifying its main characteristics (dimensions, fabric composition, care instructions, and recommended animal weights).

Products are offered within the limit of available stock. In the event of temporary or permanent unavailability of a product after an order has been placed, the Customer will be informed by email as soon as possible, and any payment made for the unavailable item will be fully refunded within 14 days.

Article 3 – Prices

Prices are indicated on the website in Euros (€) net of tax (VAT not applicable, pursuant to Article 293 B of the French General Tax Code / CGI).

Prices do not include shipping and delivery costs, which are calculated and displayed separately before the final validation of the order.

Lina Pasteur reserves the right to modify its prices at any time. However, products will be invoiced on the basis of the rates in effect at the time the order is validated by the Customer.

Article 4 – Order Process and Payment

  1. Order Validation: The Customer selects the desired products, chooses the required size/color, and adds them to the shopping cart. Before validating the order, the Customer can review the order details and correct any errors.
  2. Acceptance of T&CS: Final validation of the order requires reading and explicitly accepting these T&CS.
  3. Payment: Payment is due immediately upon ordering. Transactions are processed securely via available payment service providers (e.g., Credit Card, PayPal, Revolut). The Customer guarantees that they possess the necessary authorizations to use the selected payment method.
  4. Order Confirmation: Upon receipt of payment, a formal order confirmation email containing an invoice is sent to the Customer.

Article 5 – Shipping and Delivery

  • Delivery Area: Delivery is available within France and to selected international destinations specified during the checkout process.
  • Carriers & Processing: Orders are processed within 2 to 5 business days (excluding pre-orders or custom lead times clearly indicated on the product page). Delivery is handled by third-party carriers (e.g., La Poste / Colissimo, Mondial Relay).
  • Delivery Times: Delivery times provided are estimates. Lina Pasteur cannot be held responsible for carrier delays once the package has been dispatched.
  • Receipt of Order: The Customer must inspect the condition of the package upon receipt. In case of damage or missing items, the Customer must notify the carrier and Lina Pasteur within 3 business days.

Article 6 – Right of Withdrawal and Return Policy

In accordance with Article L. 221-18 of the French Consumer Code and European regulations, individual consumers have a period of 14 days from the date of receipt of their products to exercise their statutory right of withdrawal without having to justify reasons or pay penalties.

Conditions for Returns:

  • The product must be returned in its original condition, unused, unwashed, free of pet hair, and in its original packaging.
  • Return Shipping Costs: Return shipping fees are borne entirely by the Customer.
  • Procedure: The Customer must contact customer support at lina.pasteur.rosa@gmail.com prior to returning the item to obtain return instructions.

Refunds:

Upon receipt and inspection of the returned product, Lina Pasteur will refund the purchase price (including initial standard shipping costs) within 14 days using the same payment method used for the initial transaction.

Article 7 – Legal Guarantees

Products sold on linapasteur.fr benefit automatically and without additional payment from:

  • The legal guarantee of conformity (Articles L. 217-3 et seq. of the French Consumer Code) for products that are defective, damaged, or do not correspond to the order.
  • The legal guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code) arising from a material, design, or manufacturing defect rendering the product unfit for use.

Under these guarantees, the Customer may request repair, replacement, or a refund depending on the nature of the issue.

Article 8 – Intellectual Property

All visual, textual, and graphic elements on linapasteur.fr, including the brand name Bunrito®, product designs, photographs, logos, and descriptions, are the exclusive intellectual property of Lina Pasteur (Lina MA). Any total or partial reproduction, distribution, or exploitation without prior written authorization is strictly prohibited.

Article 9 – Liability and Force Majeure

Lina Pasteur shall not be held liable for non-performance or delay in performance of any of its obligations if such failure arises from an event of force majeure, as defined under French law and courts (including natural disasters, postal strikes, transport disruptions, or major logistics supply chain issues).

Furthermore, Lina Pasteur cannot be held responsible for damages resulting from improper or unintended use of the products.

Article 10 – Personal Data (GDPR)

Personal data collected during ordering is processed in accordance with the European General Data Protection Regulation (GDPR) and French law. For complete details regarding the collection, processing, and rights concerning your data, please refer to our Privacy Policy available on the website.

Article 11 – Applicable Law, Language, and Disputes

  • Governing Law: These T&CS and the sales resulting from them are governed by and subject to French law.
  • Dispute Resolution: In the event of a dispute, the Customer is encouraged to contact lina.pasteur.rosa@gmail.com to seek an amicable solution. In accordance with consumer law, the Customer may also resort to an official consumer mediation service or the EU Online Dispute Resolution platform.
  • Language Clause: In the event of any divergence or conflict of interpretation between the French version and this English translation, the French text shall prevail.
